Any individual (each such individual is hereinafter referred to as a "Participant") who enters, attempts to enter, or in any way participates or attempts to participate in the 2023 Penn State College of Agriculture's Ag Progress Days Extension ("Event") conducted by The Pennsylvania State University ("Penn State") agrees to be bound by the terms and conditions provided in these Official Event Rules ("Rules"), as well as by Penn State's interpretations of these Rules, which are final and binding in all matters relating to any Event.

  1. No Purchase Necessary. No purchase necessary to enter or win a prize. A purchase will not improve your chances of winning.
  2. Applicable Law/Void Where Prohibited. The Event is subject to and governed by applicable federal, state and local laws and regulations. Participation in this Event is void where prohibited or otherwise restricted by law.
  3. Eligibility. The Event is open to legal residents of the United States of America, who are at least 18 years of age or older at time of entry, except that the following individuals are not eligible for the Event: (a) employees within Penn State Extension; (b) any individual involved in the sponsorship of any Prize of the Event, and immediate family members (and those living in the same household, whether or not related) of any of the foregoing. Immediate family members shall include spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws", or by current or past marriage, remarriage, adoption, co-habitation or other familial extension.
  4. Entry. To enter the Event, an individual must "like" the official Ag Progress Days Facebook page, "share" the official Ag Progress Days giveaway promotion post, and "comment" on the official Ag Progress Days giveaway promotion post with the text "APD 2023" on Facebook. An entry must be made before August 10, 2023 8 am EST. Penn State is not responsible for problems with Event entries, including but not limited to, entries which are lost, late, misdirected, damaged, incomplete, illegible, or cannot be completed, even if the problem is the result of the sole or partial negligence of Penn State.
  5. Selection of Winner. 4 winners will be selected at random after August 10th, 2023 at 8 am EST. Winners will be contacted via private message on their Facebook page they used to enter on the day they are selected and have 7 days to respond to our message in order to receive their free shipment of a t-shirt and baseball cap. Winning is contingent on participation only, not on entry accuracy. A player may complete the entry 1 time.
  6. Prizes. Penn State will provide the following recognition and promotional support for the winning Participants:
    • 4 random winners will be selected to receive a free t-shirt and baseball hat set.
    No transfer, assignment or substitution of a prize is permitted, except Penn State reserves the right to substitute a prize for an item of equal or greater value in the event an advertised prize is unavailable. Any difference between the actual value and the approximate retail value of any prize will not be awarded. No substitution or cash equivalent will be made.
  7. Odds of Winning. The odds of winning a prize are dependent on the number of Participants and entries in the Event. Participants must submit their entry from a valid personal Facebook page to be considered for the prize drawing on August 10th, 2023 after 8 am EST.
  8. Taxes. Each prize winner shall be solely responsible for any federal, state, or local taxes associated with his/her receipt of the prize.
  9. Claiming the Prize. Penn State reserves the right to deny awarding the prize if the winner fails to provide satisfactory identification, as determined in Penn State's sole discretion. Penn State reserves the right, in its sole discretion, to award unclaimed prizes to alternate entrants or not to award the unclaimed prizes. Any costs relating to the prizes, including travel, are the sole responsibility of the winner. Winners have 7 days to claim their prize from the time they are contacted by Penn State.
  10. Release and Limitation of Liability. By participating in the Event, you hereby agree to release and hold harmless The Pennsylvania State University and its trustees, directors, officers, employees, agents, and representatives ("Released Parties") from and against any and all claims or causes of action, including but not limited to claims or causes of action arising from third party claims of infringement, or Penn State's own negligence and claims or causes of action for personal injury, death, or damage to or loss of property, arising out of participation in the Event or the receipt, use, or misuse of any prize. By participating in the Event, you also agree that you shall not be entitled in any circumstance to punitive, incidental, or consequential damages, or any other damages, including attorneys' fees.
  11. Publicity Release. Participant hereby grants an irrevocable, world-wide, royalty-free right and license to Penn State and the Released Parties to use, print, exploit, adapt, modify, reproduce, distribute, publicly perform and display any photographs, video, and/or audio (collectively "Media") taken of me for use in promotional, educational, informational, advertising or commercial materials and communications in any from now known or later developed, including but not limited to publications, websites, articles, brochures, books, magazines, newsletters, exhibits, videos, films, social media, advertisements, and training programs (collectively "Materials"). Furthermore, Participant hereby authorize and consent to the use of my name, image, likeness, biographical information, and voice (collectively, "Likeness") in the Media for all Materials or any other purposes deemed appropriate by Penn State.
  12. Disqualification. All participants agree to be bound by these Rules. Non-compliance with any of these Rules will result in disqualification and all privileges as a Participant will be immediately terminated. Penn State, in its sole discretion, further reserves the right to disqualify any person for: (i) tampering with the entry process or the operation of the Event; (ii) gaining an unfair advantage in participating in the Event; (iii) obtaining winner status using false, fraudulent or deceptive means; or (iv) engaging in otherwise unsportsmanlike or disruptive behavior.
  13. Reservation of Rights. Penn State reserves the right in its sole discretion to supplement or make changes to these Rules as well as the rules of any contest or event at any time without notice. Penn State reserves the right in its sole discretion to interpret the rules of any contest or event, and such interpretation shall be binding upon all Participants. If for any reason the Event is not capable of running as planned, including without limitation lack of significant participation, tampering, unauthorized intervention, fraud, technical failures, or other causes which adversely affect the administration, security, fairness, integrity, or proper conduct of the Event, Penn State reserves the right, at its sole discretion, to cancel, suspend and/or modify the Event.
  14. No Warranty. The prize is provided on an "as is" basis, without warranties or representations of any kind, either express or implied including, without limitation, any warranties or representations as to design, compliance with specifications, quality of materials or workmanship, merchantability, fitness for any or a particular purpose, use or operation, noninfringement, or title.
